Prosecutor Says Police Shooting Was Justified

NEW HAVEN, Conn. (AP) - A state prosecutor has ruled that an East Haven police sergeant was fully justified when he shot to death a suspect who pointed a handgun at him.
Thirty-two-year-old Brian Batten of East Haven died at Yale-New Haven Hospital after being shot by Sgt. John Miller on March 8.
East Haven police say Batten fled the scene of a reported domestic violence complaint and officers caught up to him on a dead-end road. They say they ordered Batten to drop his gun but he instead pointed it at Miller, who then shot Batten.
New Haven State's Attorney Michael Dearington says Miller was fully justified in using deadly force to protect himself and other officers. Batten's gun turned out to be unloaded.
